This is a representative version of the construction agreement Viya Constructions home owners sign. Names and project specifics are placeholders; clauses are real.

Clause structure

Each promise becomes a binding clause.

Clause 1 — Price

The contract price set out in Schedule A is the total consideration payable by the Home Owner for the construction works described in the Scope. The price shall not be increased except by a written Variation, signed by both parties, prior to the relevant work commencing. No verbal estimate, intent, or assurance shall be binding unless it is reduced to a written Variation.

Clause 2 — Time

The Builder undertakes to deliver completed handover by the Handover Date specified in Schedule B, subject only to delays caused by Force Majeure as defined herein. For each week of delay beyond the Handover Date that is not attributable to Force Majeure or to a written Home Owner instruction, the Builder shall pay the Home Owner the Delay Consequence sum set out in Schedule B.

Clause 3 — Reporting

The Builder shall deliver, every Friday by 18:00 IST without exception during the construction term, a Weekly Report consisting of: (i) dated photographs of works completed that week; (ii) a written summary of the week; (iii) a written plan for the following week; (iv) the financial position against the contracted milestone schedule. The Builder shall also maintain a live dashboard accessible to the Home Owner.

Clause 4 — Single Point of Contact

The named Consultant identified in Schedule C is the Home Owner's sole authorised point of contact for the duration of this Agreement. The Consultant shall not be substituted except with the Home Owner's written consent, save in circumstances of incapacity or termination of employment, in which case the Builder shall propose a successor within five (5) business days.

Clause 5 — Structural Cover

For ten (10) years from the date of Handover, the Builder shall remediate at its own cost any defects arising from structural failure or waterproofing failure that is attributable to the construction works performed under this Agreement. This cover survives any reorganisation, sale, or restructuring of the Builder, and shall be a binding obligation on any successor entity.

Clause 6 — Variations

Any change to the Scope, the Materials Specification (Schedule D), or the Handover Date may only be effected by a written Variation. A Variation shall set out (a) the nature of the change, (b) the price impact, (c) the schedule impact, and (d) shall be signed by both parties before the relevant work commences. Verbal directions shall not bind either party.
